1. The provisions contained in this section constitute rights granted exclusively to Customers who are Consumers.
2. The Customer has the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires after 14 days from the day on which the Customer takes possession of the goods or on which a third party other than the carrier and indicated by the Customer takes possession of the goods under the Act of May 30, 2014 (Journal of Laws 2014, item 827, as amended). The above-mentioned right also applies to a natural person entering into a contract not directly related to their business activity, when the content of this contract shows that it does not have a professional nature for that person, resulting in particular from the subject of their business activity, made available under the provisions of the Central Register and Information on Business Activity.
3. The Customer may submit a declaration of withdrawal from the contract in writing by mail to the address: Greenspot sp. z o.o, Leńcze 110, 34-142 Leńcze or electronically to the email address: reklamacje@greenspot.pl
4. Submitting a declaration of withdrawal from the contract without using the form does not affect the effectiveness of the withdrawal. For the effectiveness of the declaration of withdrawal, it is sufficient to send the declaration before the deadline expires.
5. The Seller immediately confirms via email (to the address provided when placing the order) the receipt of the declaration of withdrawal from the contract.
6. The Consumer should return the purchased products within 14 days from sending the declaration of withdrawal to the address: Greenspot sp. z o. o. , Leńcze 110, 34-142 Leńcze
7. In case of sending a declaration of withdrawal from the contract, the contract is considered not concluded.
8. The Seller bears the direct costs of returning purchased products, but only when choosing the cheapest shipping option. If a shipping option other than the cheapest one is chosen, the consumer bears the costs of returning the purchased product.
9. If during product assembly a product defect or non-compliance with the order is noticed, the Customer is obliged to immediately send the entire product or the defective part of the product to the provided address and notify the Seller about the defect.
10. If the customer undertook product assembly and use while one of the parts was visibly defective or the product was incomplete, and consequently other elements of the product’s structure were damaged, the Customer bears compensation liability for the product.
9. The Consumer bears compensation liability for the reduction in the value of items resulting from failure to follow the remarks, instructions, and recommendations contained in the product manual and for careless packaging of the returned product.
10. The Seller is obliged to immediately, no later than within 14 calendar days from receiving the consumer’s declaration of withdrawal from the contract, refund all payments made by the consumer, including product delivery costs (excluding additional costs resulting from the Customer choosing a delivery method other than the cheapest standard delivery method offered by the Store). The Seller refunds the payment using the same payment method used by the Consumer, unless the
consumer has explicitly agreed to a different method of refund.
11. The Seller may withhold the refund of payments received from the Consumer until the Product is received back or until the Consumer provides proof of its return shipment.
Complaints
1. The Seller is obliged to deliver products free from physical and legal defects.
2. The Seller’s liability for physical or legal defects expires after two years from the date of product delivery. Before the expiration of the above deadline, the consumer may notify the Seller about discovering a defect by sending an appropriate email to reklamacje@greenspot.pl or calling +48 880 981 195
3. The right to complaint mentioned above also applies to a natural person entering into a contract not directly related to their business activity, when the content of this contract shows that it does not have a professional nature for that person, resulting in particular from the subject of their business activity, made available under the provisions of the Central Register and Information on Business Activity.
4. The Consumer is not bound by the above methods of filing complaints. They may submit a complaint in any way provided it uses a durable medium.
5. The complaint submission should include:
● first and last name or company name of the buyer;
● correspondence address/registered office;
● attached proof of product purchase (e.g., receipt, invoice, transfer confirmation, etc.);
● photo of the product defect
● indication of the defect describing the non-compliance of the goods with the contract and the date of its occurrence;
● complainant’s request (withdrawal from the contract, price reduction, product replacement, defect removal);
● date of submission and signature of the complainant.
6. The Seller confirms receipt of the complaint and calls on the consumer to immediately deliver the defective product at their own expense to the seller’s address: Greenspot sp. z o. o. , Leńcze 110, 34-142 Leńcze
7. If the complaint is accepted, shipping costs will be refunded (excluding additional costs resulting from the Customer choosing a delivery method other than the cheapest delivery method offered by the Seller)
8. If the complaint is not accepted, the goods will be returned along with an opinion regarding the unjustified nature of the complaint.
9. If the Seller does not respond to the Consumer’s complaint within 14 calendar days from the day the complaint is delivered, it is assumed that the Seller has accepted the consumer’s complaint and their request. The 14 calendar day period is counted from the delivery of the complete set of documents mentioned in point 4 by the customer and the delivery of the defective product.
10. The Seller may refuse to accept a product complaint if the Customer did not follow the remarks, instructions, and recommendations contained in the product manual, and this resulted in a defect of part or all of the product.
