Returns and Complaints

RIGHT OF WITHDRAWAL (RETURNS)

 

1. Scope of application

  1. The provisions of this section apply exclusively to the Consumer, as well as to a natural person conducting business activity, provided that the contract is not directly related to their professional activity (so-called entrepreneur with consumer rights).

  2. The right of withdrawal does not apply to customers acting as businesses, in particular:
    • limited liability companies
    • joint-stock companies
    • partnerships
    • other legal persons or organized entities

even if the purchase was made at a distance.

  1. The Seller does not grant the right of withdrawal to businesses, unless expressly agreed otherwise in writing on an individual basis.

2. Withdrawal period

  1. The Consumer has the right to withdraw from the contract within 14 days without giving any reason.

  2. The withdrawal period starts on the day on which the Consumer or a third party indicated by the Consumer, other than the carrier, takes possession of the product.

  3. To meet the deadline, it is sufficient to send the withdrawal statement before the expiry of the withdrawal period.

3. Exclusions from the right of withdrawal

The right of withdrawal does not apply if:

  1. The product has been manufactured according to the Customer’s individual specifications, in particular if it includes:
    • engravings
    • personalization
    • dedications
    • other individual features

  2. The Customer:
    • failed to follow the assembly, usage or safety instructions provided with the product or sent by e-mail
    • assembled the product despite visible defects or missing parts
    • used the product in a manner inconsistent with its intended purpose

  3. The product was damaged due to the Customer’s fault.

4. Exercise of the right of withdrawal

The withdrawal may be submitted:

The use of a withdrawal form is not mandatory.

5. Return of the product

  1. The Consumer is obliged to return the product within 14 days from sending the withdrawal statement.

  2. The product must be returned:
    • properly packaged to prevent damage during transport
    • complete, with all its components

  3. The Consumer is responsible for any reduction in the value of the product resulting from:
    • improper packaging
    • damage occurring during return transport
    • use exceeding what is necessary to check the nature and characteristics of the product

  4. In case of damage, the Seller has the right to reduce the refund amount or charge repair costs.

6. Return costs

  1. The direct costs of returning the product are borne by the Consumer.

  2. Return shipping costs are not refunded.

7. Risk of return shipment

  1. The risk of loss or damage of the returned product passes to the Seller only upon physical receipt of the product.

  2. Until that moment, the Consumer bears full responsibility for the shipment.

  3. It is recommended to send the return with tracking and proof of dispatch.

8. Refund

  1. The refund will be made within 14 days of receipt of the withdrawal statement.

  2. The Seller may withhold the refund until:
    • the returned product has been received, or
    • the Consumer has provided proof of shipment

  3. The refund will be made using the same payment method used by the Consumer, unless otherwise agreed.


COMPLAINTS / WARRANTY

1. Seller’s liability

  1. The Seller is liable for physical and legal defects of the product for a period of 2 years from the date of delivery.

  2. Warranty rights apply exclusively to Consumers and entrepreneurs with consumer rights.

2. Submission of a complaint

  1. Complaints may be submitted:
    • by e-mail: reklamacje@greenspot.pl
    • by phone: +48 880 981 195

  2. The complaint should include:
    • the Customer’s name and address
    • proof of purchase
    • description of the defect and the date it occurred
    • photos of the defect
    • the Customer’s request

3. Return in case of a complaint

  1. The Customer is obliged to send the complained product initially at their own expense to the Seller.

  2. If the complaint is accepted, shipping costs will be refunded up to the amount of the cheapest available shipping method.

4. Exclusion of liability

The Seller may refuse the complaint if the defect results from:
• failure to follow instructions
• incorrect assembly
• improper use
• structural modifications to the product
